What the law actually says
The National Gambling Act 7 of 2004 is the governing statute. Section 11 makes it an offence to engage in, or make available, interactive gambling — the Act’s term for gambling conducted over an electronic communications network — unless it is licensed under the Act. No licences for interactive casino play have been issued to date, so the offer of online casino games from within the country has no legal footing.
The National Gambling Board (NGB) and the nine provincial licensing authorities share the regulatory work. Provincial boards license the venues and the bookmakers; the NGB oversees the national framework.
What is licensed in South Africa
- Land-based casinos — around forty venues, each licensed by its provincial board.
- Sports betting — bookmakers holding a provincial licence may take bets online, which is why betting sites with a .co.za address operate openly.
- The National Lottery and its associated games.
- Bingo and limited payout machines in licensed premises.
The 2026 change that closed a loophole
For several years some licensed bookmakers offered casino-style games — slots among them — by routing play through a remote gambling server and treating each spin as a bet. In February 2026 the National Gambling Board formally notified the industry that remote gambling servers used in this way are not covered by a bookmaker licence. That route is closing, and it is the reason the mix of games on some South African betting sites has been changing.
Is reform coming?
The Remote Gambling Bill (B11-2024) was introduced in Parliament in April 2024. It proposes a licensing regime for remote gambling, which would cover online casino play for the first time. It has not been passed, and until it is, nothing in this section changes.
Practical points
- The legal age for gambling in South Africa is 18.
- Offshore operators publish their own licence details — usually Curaçao, Malta or the Isle of Man. A licence from another jurisdiction is not a South African licence, and we never describe it as one.
- Money moves in rand through EFT, instant-EFT services and voucher systems, but the operator holds the account under its own regulator’s rules, not under the National Gambling Act.
